PERSONAL DATA & PRIVACY POLICY NOTICE


This Personal Data & Privacy Policy Notice is issued to all our valued beneficiaries, volunteers, donors and corporate partners/business associates, pursuant to the requirements of Malaysia Personal Data Protection Act 2010.

We at Pertubuhan Kebajikan Oasis Harapan (OH), treat and view your data seriously. In line with the Personal Data Protection Act 2010 (PDPA), this is to ensure that your data will not be used for purposes other than that which is necessary to run our programmes.


NATURE OF PERSONAL DATA

OH will process your personal data which has been voluntarily provided by you to OH. The lists of data may be in the form of but is not limited to:
  • Name, job title and OH name;
  • Age, gender, date of birth, national registration identification card number (NRIC), passport number;
  • Nationality, race, religion;
  • Marital status, details of employers;
  • Contact details ( i.e. phone number, mobile phone number, home address, mailing address and email address), and;
  • Any personal data which derives from any form of documentation.
Sensitive Personal data may also be collected manually in order for OH to provide specific services.

For sensitive personal data, explicit consent will be obtained from the individual for processing of the personal data.


PURPOSE OF PERSONAL DATA

The data will be processed for the following purposes:
  • To process applications for and the provision of our services;
  • For administration purposes (i.e. to contact, response to your enquiries, providing you with the latest updates of OH);
  • To inform you about the programmes we have;
  • To inquire as to your participation in the programmes we have;
  • To adhere to legal and statutory requirements;
  • For the maintenance of our database;
  • For billing and financial purposes;
  • For the purpose of verification against child related crimes to ensure the safety of children in the programmes
  • For all other purposes incidental and associated with any of the above.
Do note that the list above is non-exhaustive. We will inform you and obtain your consent should we use your data for any other purposes other than those mentioned above.


USE & DISCLOSURE

We may disclose your personal data for the above purposes to the following parties:
  • Any of our OH staff who is employed to ensure that your data is protected;
  • Any of our OH staff who uses the data for the purposes of running and facilitating our programmes;
  • Any of our OH staff who uses the data for administrative purposes;
  • Any partner, agent or service providers which helps us to run and facilitate our programmes;
  • Third parties who provides data processing services; and
  • Any person to whom we are compelled or required to do so under law or in response to a competent or government agency and law enforcement purposes.
Do note that the list above is non-exhaustive. We will inform you and obtain your consent should we disclose your data to any other parties other than those mentioned above.


SAFEGUARDS AND CONFIDENTIALITY

We shall keep and process your data in a secure manner. We endeavour, where practicable, to implement the appropriate administrative and security safeguards and procedures in accordance with the applicable laws and regulations to protect the security and integrity of your Personal Data.


IMPACT RESULTING FROM FAILURE TO SUPPLY PERSONAL DATA

Failure to supply such personal data might or will:
  • Result in us being unable to provide the appropriate service to you in the running of our programmes; and
  • Result in us being unable to perform any proper administration job (i.e. to contact, response to your enquiries, providing you with the latest updates of OH).


ACCESSING AND CORRECTING YOUR DATA

If you would like to access or make amendments to your personal data or for more information regarding policies and procedures or would like to be removed from our mailing list, you may write to info@oasisharapan.org.my. We can be contacted via our office at +603-97655578 or +6012-2266881. However, any request to access or correct your personal data will be subjected to legal requirements under the act.

REFUND POLICY


  1. No refund/cancellation for Donations through any mode of payment will be allowed for any Donors unless the Donor made a technical fault/error, such as transaction duplicity, data entry mistake or any other circumstances Pertubuhan Kebajikan Oasis Harapan (OH) at its sole discretion deems fit. The refund/cancellation for Donations must be made within three (3) days from the date of transaction (the date the Donation was made) or before the Donation received is disbursed to the Beneficiary, otherwise OH will not process any refund/cancellation request.

  2. In the event if the refund is issued, the refund will be made automatically to the donor’s credit/debit card, eWallet or original method of payment within certain amount of days. For FPX, the refund will only be to the designated bank account. If your refund is not approved, OH will inform the donor accordingly.

  3. Ongoing support is important to enable continuous run of our projects and mission, so we encourage donors to continue to contribute to our mission and projects over time. But if you decided to cancel your donation, please notify us within three (3) days from the date of transaction (the date the Donation was made) by emailing to support@ipay88.com.my / help@senangpay.my and cc to info@oasisharapan.org.my.

CHANGE OF POLICY


OH reserves the right, at its sole discretion, to change, modify, add and/or remove any part of this Policy, at any time. You are required to check the Policy and our personal data protection notice periodically for any updates and/or changes.

Unless notified otherwise, your consent is deemed to be given to us in processing your personal and sensitive personal data AND you are deemed to agree and accept the modifications and changes (if any) in our personal data protection notice & privacy policy.
